Bankruptcy And Student Loans
Ben Said:
can i file bankruptcy on student loans? We Answered:
Due to bankruptcy reforms in 1998 and 2005, it’s almost impossible for the average person to discharge federal or private student loans through bankruptcy. Although your student loan can’t be discharged in bankruptcy, a bankruptcy court may be able to ease an overwhelming debt burden. Some courts may discharge a portion of your student loans, but this is rare and varies by court.Elizabeth Said:

is there any way to file chapter 7 bankruptcy on student loans? We Answered:
as has been previously answered, there is no way to discharge a student loan. The reason is because they are backed by the government. Nothing short of your death ( and please don't think thats an acceptable option) will get rid of this debt.If you are young enough (under 42) you can join the military and have them pay off up to 60K of that. Other than that, the government will begin to garnish your wages as well as your income tax checks until its paid off.
The only other solution and im not really recommending this would be to go back to school at least half time status. That will put your student loans on hold. Some people call this "the student loan scam" In theory, if your in school at least 1/2 time forever your loans will never be due.
Good luck and if your completely desperate, look into the military option.

can you file bankruptcy to include student loans? We Answered:
Student loans cannot be discharged in bankruptcy. They must be paid in full. Furthermore, there is NO statute of limitations regarding student loans, so if you go into default, they remain collectable even after you are dead.
